01 Introduction

Welcome to TheWashLabs ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our cleaning services, website, and any related interactions. By booking our services or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

TheWashLabs is a window and gutter cleaning service provider operating in Calgary, Alberta, and surrounding areas within Canada. These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.

02 Definitions

"Services" refers to all cleaning services provided by TheWashLabs, including but not limited to window cleaning, gutter cleaning, soft washing, pressure washing, and any other related services.

"Client" or "You" refers to the individual or entity engaging our services.

"Service Agreement" refers to the specific agreement between TheWashLabs and the Client for the provision of Services.

"Property" refers to the location where Services are to be performed.

"Working Day" means any day from Monday to Friday, excluding statutory holidays observed in Alberta, Canada.

03 Service Agreement

A Service Agreement is formed when:

  • You request a quote or book our Services through our website, phone, or in-person;
  • We provide a written or verbal confirmation of your booking; and
  • You agree to the scope of work, pricing, and schedule provided.

We reserve the right to refuse service to any client at our sole discretion, including but not limited to situations where the property conditions pose safety risks or where access is restricted.

04 Client Obligations

As a Client, you agree to:

  • Provide Safe Access: Ensure our team has safe and unobstructed access to all areas requiring service, including windows, gutters, and exterior surfaces.
  • Clear Obstacles: Remove or secure any pets, vehicles, outdoor furniture, and other obstacles that may interfere with our work.
  • Disclose Hazards: Inform us in advance of any known hazards on the property, including but not limited to broken glass, unstable structures, electrical wires, or asbestos-containing materials.
  • Provide Utilities: Ensure access to an outdoor water source and electricity (where required) for the duration of the service.
  • Securing Valuables: Secure all valuable items and ensure windows and doors are unlocked where access is required.
  • Supervision of Minors: Ensure that children and pets are kept away from the work area during service delivery.

Failure to meet these obligations may result in delays or cancellation of services, for which you may be liable for cancellation fees.

05 Our Obligations

TheWashLabs agrees to:

  • Perform Services: Provide cleaning services with reasonable skill and care, in accordance with industry standards and specifications outlined in the Service Agreement.
  • Qualified Personnel: Assign trained and qualified personnel to perform the Services.
  • Use Safe Equipment: Utilize proper, well-maintained equipment and techniques appropriate for the task.
  • Comply with Laws: Adhere to all applicable provincial and federal health and safety regulations, including the Alberta Occupational Health and Safety Act.
  • Insurance: Maintain valid liability insurance as required by law in Alberta for commercial cleaning operations.
  • Prompt Notification: Notify you of any delays, issues, or changes to the service schedule as soon as reasonably possible.
06 Pricing and Payment

All prices quoted are in Canadian Dollars (CAD) and exclude applicable taxes (GST/HST) unless otherwise stated. We strive to provide accurate and transparent pricing. However, pricing may be subject to change based on:

  • Site conditions that differ from the initial assessment;
  • Additional services requested after the initial quote;
  • Unforeseen circumstances requiring additional time, equipment, or materials;
  • Travel costs for locations outside our standard service area.

Payment Terms:

  • Payment is due upon completion of Services, unless otherwise agreed in writing.
  • We accept cash, e-transfer, credit card, and debit card payments.
  • Late payments may be subject to interest charges of 1.5% per month (18% per annum).
  • In the event of non-payment, we reserve the right to pursue collection through legal means, and you agree to cover all reasonable collection costs and legal fees.
07 Quotes and Estimates

Quotes provided by TheWashLabs are valid for a period of thirty (30) days from the date of issue, unless otherwise stated. All quotes are subject to a site inspection and may be revised if:

  • Services are required outside of standard business hours (Monday-Friday, 8:00 AM - 5:00 PM);
  • Weather conditions impact the ability to perform the services as scoped;
  • Access limitations require additional time or equipment;
  • Property conditions reveal structural issues or safety hazards.
08 Cancellation and Rescheduling
โฐ Please Note: Our cancellation policy is designed to be fair to both you and our team.

Cancellation by Client:

  • Free cancellation up to 48 hours before the scheduled service time.
  • Cancellations between 24 and 48 hours before service: 25% of the total service cost.
  • Cancellations less than 24 hours before service: 50% of the total service cost.
  • Same-day cancellations or no-shows: 100% of the total service cost.

Rescheduling by Client:

  • Rescheduling requests made 24+ hours before service are free of charge, subject to availability.
  • Rescheduling requests made within 24 hours may incur a $50.00 administrative fee.

Rescheduling by TheWashLabs:

  • If we need to reschedule due to weather, equipment failure, or other unforeseen circumstances, we will offer alternative dates at no extra cost.
  • In such cases, we will notify you as early as possible and work to find a suitable alternative time.
09 Weather Policy

Since many of our services are performed outdoors, weather conditions play a significant role in service delivery. We reserve the right to:

  • Delay or reschedule services due to: heavy rain, lightning, high winds (exceeding 40 km/h), snow, ice, extreme temperatures (below -15ยฐC or above 35ยฐC), or any conditions that pose a safety risk to our team.
  • Completely cancel and refund services if weather conditions make it impossible to complete the work within a reasonable timeframe.

We will make every effort to inform you of weather-related changes at least 2 hours before the scheduled start time.

10 Liability and Disclaimer

TheWashLabs accepts liability for direct damages caused by our negligence during the provision of Services, subject to the following limitations:

  • Our total liability is limited to the total amount paid by you for the specific Services provided.
  • We are not liable for:
    • Indirect, consequential, or incidental damages;
    • Damage to property that is not reasonably visible or foreseeable;
    • Damage caused by pre-existing conditions of the property;
    • Damage caused by failure to disclose known hazards;
    • Damage caused by weather events or acts of nature;
    • Loss of data, business interruption, or loss of profits;
    • Any damage where you have failed to comply with your obligations under these Terms.

We recommend that you review your own insurance policies to ensure adequate coverage for your property during service delivery.

โš ๏ธ Important Limitation: Our liability shall not exceed the total value of the Service Agreement. You acknowledge that this limitation is reasonable given the nature and cost of the services provided.
11 Warranty and Satisfaction Guarantee

TheWashLabs stands behind the quality of our work. We offer a 100% Satisfaction Guarantee on all services:

  • If you are not satisfied with the quality of our work, notify us within 48 hours of service completion.
  • We will return to re-clean the affected areas at no additional cost.
  • The Satisfaction Guarantee does not cover:
    • Areas that were not specifically included in the original Service Agreement;
    • Damage caused by third parties or weather after our service;
    • Normal wear and tear on windows, gutters, or other surfaces;
    • Areas where the property condition was not accurately disclosed;
    • Services cancelled or interrupted due to weather conditions.

This warranty is in addition to your rights under the Consumer Protection Act (Alberta) and other applicable legislation.

12 Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of TheWashLabs and is protected by Canadian copyright laws. You may not reproduce, distribute, or use any content without our express written permission.

13 Privacy and Data Protection

TheWashLabs is committed to protecting your privacy. We collect, use, and disclose personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

We collect personal information for the purpose of:

  • Providing our services;
  • Processing payments and invoicing;
  • Communicating with you about your service;
  • Marketing our services (with your consent);
  • Complying with legal obligations.

We do not sell or share your personal information with third parties except as necessary to provide our services or as required by law. For more information, please refer to our Privacy Policy.

14 Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Calgary, Alberta, Canada, and you consent to the jurisdiction of such courts.

15 Dispute Resolution

In the event of a dispute arising from these Terms or our Services, we encourage you to first contact us directly to resolve the issue amicably. If we are unable to resolve the dispute, you agree to the following escalation process:

  • Step 1: Informal negotiation between you and TheWashLabs;
  • Step 2: Mediation by a neutral third party mutually agreed upon;
  • Step 3: Binding arbitration in accordance with the Arbitration Act (Alberta);
  • Step 4: Litigation in the courts of Calgary, Alberta.

This dispute resolution process shall not preclude you from exercising your rights under the Consumer Protection Act (Alberta) or other applicable consumer protection legislation.

16 Amendments to Terms

TheWashLabs reserves the right to update or modify these Terms at any time without prior notice. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.

For significant changes that materially affect your rights, we will make reasonable efforts to notify you via email or through our website.

17 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

18 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of TheWashLabs.

19 Entire Agreement

These Terms, together with any Service Agreement, constitute the entire agreement between you and TheWashLabs regarding the subject matter herein and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
